1. Your privacy is important

1.2 Who processes your data? Who are we?

Delino NV is a public limited company that operates in Belgium and in several European countries. The company has its registered office at ’t Walletje 51, 8300 Knokke-Heist, with VAT number BE 0425.364.103 and is responsible for processing your personal data.

2. Your right to privacy

You have many rights regarding the processing of your personal data.

Your rights will be exercised in our systems and procedures no later than 30 days after we have received your application. If we are unable to meet this deadline for any reason, we will inform you before the original period lapses.

 

2.1 You may inspect your personal data

You have the right to gain access to your personal data that we process, the purpose of the processing, where we obtained the data, and who has received the data.

In this case, you can also learn about how long we store the data, whether the data is used for performing automated decision-making and whether we intend to send the data to a country outside of the European Union.

We will send you the information requested in writing or electronically.

 

2.2 You can have your data rectified/made complete

It is possible that the data we hold about you is out-of-date or incorrect. You can submit a request at any time to rectify the incorrect data or add data that is missing.

 

2.3 Right to delete

If you think that we are irregularly processing personal data, you may request that we delete such personal data.

This request for deletion of personal data can be refused by Delino if it is justified. Examples are the exercise or substantiation of a legal claim or because of a legal obligation to keep certain data.

 

2.4 Right to restrict personal data

You can ask us to restrict the processing of your personal data if you suspect that the data is incorrect, the processing is unlawful or if you do not agree that we process the data under our legitimate interest (see article 3.3).We will comply with this objection unless there are compelling reasons for not doing so, for example, to prevent fraud or non-payment.

 

2.5 Right to object

You have the right to object to the processing of your personal data, including profiling. The processing will then be stopped unless it is required for compliance with social and fiscal legislation or to protect the interests of a third party or with a view to the establishment, exercise, or substantiation of a legal claim.

Please be as specific as possible if you wish to exercise your rights. In this way, we will be able to correctly handle your request.

In order to prevent someone else from exercising your rights, we would like to verify your identity as carefully as possible. For this reason, you should always send a document with your application that proves that the identity of the applicant corresponds to your identity. You can do this by enclosing a copy of your identity card with the application. When doing this, you should redact information such as your photo and identity card number to protect your privacy.

We will inform you if we believe that the document you submit does not contain sufficient proof. We reserve the right not to handle your application until you have provided sufficient proof.

 

3 Why do we want to process your personal data?

3.1 Delino is subject to legal obligations

In some cases, we are legally required to process your personal data. Here are some of the most important cases:

  • tax law;
  • commercial law;
  • the possibility that we will be obliged to furnish personal data to authorities or other third parties. For instance, if we have to do this because of a legal requirement or to perform a duty of public importance.

3.2 Delino must be able to perform its contract with you

As a customer, you rely on our services or purchase our products. In order to guarantee the correct performance of our agreement, we have to process and manage these contracts and quotations in our administrative records, accounts and for operational purposes.

As an existing customer or an active prospect, Delino would like to communicate with you through direct marketing. This may be in response to a specific request you have made, or we may assume that you are interested in our new products. Since our aim is to constantly provide a better service, offer better products, and we want to communicate this to you, we process your personal data for direct marketing under the legitimate interests of our company to conduct its business. Nevertheless, if you do not want to receive our commercial communication, simply let us know and we will stop sending it to you.s

 

3.4 Delino requests your permission

When you subscribe to our newsletter, you implicitly give your permission to receive information about our products. Each newsletter always contains an option to unsubscribe..

We only process personal data that you give us during a trade fair or event with your consent.

If we have obtained your personal data through your company, we will first ask for your permission before we send you our electronic newsletters.

4 What personal data of yours do we process and for what purposes?

4.1 Our business relations

Our customers and suppliers are our business relations. Delino processes the personal data of people who work for companies with which we do business. The purpose of this processing is to provide information about products and services and to maintain business relations.

In order to contact and identify you, we process the following data for our customer and supplier management system: surname, first name, address, telephone number, mobile number, language, email address, bank account number, VAT number.

 

4.2 Our prospective purchasers

Our new potential customers have shown an interest in what we offer. Delino therefore would like to keep them updated about products and follow up quotations. In order to communicate with them, we process the following data: surname, first name, address, telephone number, mobile number, language, email address, VAT number.

 

4.3 Cookies

4.5 Footage from security cameras are temporarily saved

We save video recordings for a maximum of 30 days. Exceptions to this are:

  • recorded footage that is useful for providing evidence of a crime or nuisance;
  • we can use the footage to prove damage or loss;
  • identification of a perpetrator, witness or victim.

Footage is processed under our legitimate interests to protect our buildings and other property, for instance, against burglary, damage, etc.

 

5 Sharing and storing your personal data

5.1 Who do we share your personal data with?

We only share your data with persons who have expressly received permission from us and if they need this data to perform their duties. These persons will process your data under the same grounds as we have received the data from you.

We rely on various processors to process personal data. These are subcontractors who we instruct to process personal data. Delino only works with processors who guarantee the same security at a technical and organisational level.

Aside from this, we only share your data if we are required to do so by a law or a government order.

 

5.2 Delino does not pass on your personal data to third parties

We will not sell, rent or share your personal data or make it commercially available in any other way to third parties, unless you have given permission in advance.

 

5.3 We do not store your data indefinitely

Delino uses your personal data with a clear objective in mind. When this objective has been reached, we delete your data.

The starting point for retaining your personal data is the legal retention period.

We store the personal data of existing customers and suppliers for up to 10 years after the last invoice.

We initially store the personal data of prospects for 5 years. If there has been contact during this period between the prospect and Delino, a new period of 5 years will start from that moment.
